This session offers a deep dive into some of the tricky points for employment lawyers advising employers or employees impacted by insolvency processes, including:

  • The challenges for employers of balancing consultation / HR1 obligations with wider legal and commercial constraints
  • Adoption of employment contracts – consequences for employees and employers
  • Personal liability for insolvency practitioners
  • The ability to claim payments from the National Insurance Fund, and the interaction with the insolvency ‘waterfall’
  • Claims against insolvent employers (or insurers?) – key points for employees to consider, including the impact of multiple insolvency events, consequences of a transfer of employment to a solvent employer, and navigating stays on litigation
