Data, Visas and Cross-Border TUPE – Three Key Practical Hot Topics Post-Brexit

In any deal involving employees in more than one European country, three topics consistently throw up interesting practical challenges. In this practical session, organised by the ELA International Committee, experienced speakers will give their views on each of these ‘hot topics’ in the post-Brexit world.

  1. Immigration. The new immigration requirements on worker movement between the EU and the UK are now a reality. What are the new requirements?  What UK immigration issues should employment lawyers look out for on deals? What are the key UK immigration points to have in mind when advising on transactions involving workers on temporary sponsorship visas?”
  2. Data. Every deal starts with employee due diligence. Are there new rules of the road on how employee data must be processed on deals? What are the practical questions that arise when managing cross-border due diligence exercises? How does the UK’s ‘third country’ status affect our approach to the review, use and disclosure of employee data on transactions?
  3. ARD/TUPE.  We have grappled with the idea of the cross-border application of the ARD and TUPE for a number of years. What is the impact of Brexit on this analysis? What is the likely direction of travel for employees being moved between the UK and the EU on integration following a deal? What other issues should we look out for when advising on the impact of the ARD and TUPE cross-border?
