Tom and Craig each have very extensive experience of acting for Claimants and Respondents in whistleblowing cases. They were on opposite sides for much of Passi v Nissan. Together they will give their perspectives on the legal and strategic pitfalls for each side.

They will deal with the following (subject to new case law altering the balance):

  • Provision of documents by C to solicitors – Nissan v Passi
  • Pleading the claim – disclosures of information vs opinion
  • Selecting the best protected disclosures
  • The choices a Respondent faces when pleading
  • Strike outs after Carr  v Bloomberg
  • Proving Causation - Oxford Said v Heslop, Fitzmaurice v Luton Irish, Watson v Hilary Meredith
